Good Start® | Dr. Brown’s™ “Gentle Formula Contest 2025” Official Rules ("Official Rules")
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE OR PAYMENT WILL NOT INCREASE A PARTICIPANT’S CHANCE OF WINNING. THIS CONTEST IS VOID WHERE PROHIBITED.
THESE OFFICIAL RULES CONTAIN A RELEASE OF LIABILITY IN SECTION 12 AND VARIOUS LIMITATIONS AND EXCLUSIONS OF LIABILITY IN SECTION 13.
1. SPONSOR AND ADMINISTRATOR: The Good Start® | Dr. Brown’s™ “Gentle Formula Contest 2025” (the “Contest”) is sponsored by PBM Nutritionals, LLC, 515 Eastern Avenue, Allegan, Michigan 49101 (“Sponsor”).
2. CONTEST PERIOD: Participants may enter the Contest beginning on July 1, 2025, at 9:00 AM Eastern Time (“ET”) and must enter by July 31, 2025, at 11:59 PM ET (the “Contest Period”). Sponsor’s clock will be the official clock of the Contest. The Contest is void where prohibited or restricted by law, is subject to applicable federal, state, provincial, territorial and local statutes, rules, codes of practice, regulations, guidance from regulatory bodies and other laws (each a “Law” and collectively the “Laws”), and is governed by these Official Rules.
3. ACCEPTANCE OF THE OFFICIAL RULES; SITE POLICIES: Each individual who enters the Contest is referred to in these Official Rules as an “participant”. By entering the Contest, each participant accepts and agrees to comply with and abide by these Official Rules and by the decisions of the Sponsor, which shall be final and binding on all matters pertaining to the Contest. Participation in the Contest is also governed by the terms and policies pertaining to the contest website at: https://www.goodstartbaby.com/ (the “Contest Site”), which may be viewed on the Contest Site. The collection, use, and disclosure of information obtained online from participants in the Contest is governed by Sponsor's privacy policy, which may be viewed at https://www.goodstartbaby.com/pages/privacy (such privacy policy and the Contest Site terms and policies are referred to in these Official Rules as the “Policies”). In the event of a conflict between any of the Policies or any Contest promotional materials and these Official rules, these Official Rules shall prevail and govern as to any matter pertaining to the Contest. By entering the Contest, each participant also agrees to comply with any and all applicable Laws in connection with his/her participation in the Contest. Entry in the Contest does not constitute entry into any other promotion, sweepstakes, or contest.
4. ELIGIBILITY:
a. Only individuals who at the time of entry (i) are legal residents of the fifty (50) United States or the District of Columbia (but not Puerto Rico, Guam, or U.S. Virgin Islands), (ii) are at least 18 years of age or the legal age of majority in the participant’s state of residence if higher than age 18, and (3) are a caregiver to a baby born after September 1, 2024, and prior to August 1, 2025, are eligible to participate or win this Contest. Sponsor does not warrant that this Contest is valid in any particular jurisdiction. Individuals in jurisdictions where this Contest is prohibited by applicable Laws are ineligible to participate in this Contest.
b. Employees, officers, directors, agents, or representatives of any of the Contest Entities, or their immediate family members (defined as a person’s spouse, parents, legal guardians, children, grandparents, and/or siblings, regardless of where they live), and/or persons living in the same households of such persons, whether or not related, are not eligible to enter or win this Contest. “Contest Entities” means the Sponsor and its parent companies, subsidiaries, and affiliates, as well as any other prize providers, promotional partners, advertising/marketing agencies, and any other company or organization involved in the design, promotion, sponsorship, or execution of the Contest.
5. HOW TO ENTER: NO PURCHASE OR PAYMENT NECESSARY. Participants may enter the Contest via the method set forth herein:
Online: To enter online, during the Contest Period, a participant must submit all of the following information through an entry form on the Contest Site (collectively, an “Entry”):
a. The participant’s full name, email, state/territory of the primary residence of the participant, and baby’s date of birth;
b. The participant’s age at the time of submission; and
c. A short written piece of 100 words or less in response to the following prompt: Describe what makes feeding time with your baby special.
6. ADDITIONAL ENTRY REQUIREMENTS; REPRESENTATIONS BY PARTICIPANTS:
a. All online Entries must be submitted by 11:59PM ET on July 31, 2025.
b. Each participant must enter the Contest as an individual. Each participant may only submit (1) Entry.
c. All Entries become the sole and exclusive property of Sponsor and will not be returned. Receipt of Entries may not be acknowledged, and proof of submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for, and shall not be liable for late, lost, misdirected, unsuccessful, damaged, postage-due, stolen, or illegible Entries for any reason. Entries that are mutilated, tampered with, illegible, invalid, or incomplete are not eligible and will not be accepted.
d. Each Entry (including the Contest entry form and all other works of authorship, data, information, content, and other materials included in the Entry) must comply with the following:
i. It must be entirely the original work of the participant. The submitted artwork or image (in whole or in part) cannot be (x) created using any artificial intelligence tool or generator; or (y) created using any pre-existing assets from computer tools or programs (e.g., stock images, logos, etc.).
ii. It must not infringe, misappropriate, or violate any intellectual property rights, privacy rights, publicity rights, or other proprietary rights of any third party.
iii. All information provided in the Entry must be true, accurate, and correct in all respects.
iv. It must not be created or submitted through any script, macro, or other automatic method.
v. It must comply with these Official Rules and all applicable Laws.
vi. It must be suitable for publication to a general audience and must not contain anything that:
1) is illegal, abusive, tortious, defamatory, pornographic, sexually explicit, obscene, libelous, invasive of another's privacy, hateful, or otherwise objectionable;
2) promotes discrimination based on race, ethnicity, nationality, religion, sex, sexual orientation, disability, or age;
3) promotes violence or unsafe or illegal activity;
4) is threatening, harassing, or degrading;
5) serves to impersonate any person or entity or misrepresent affiliation with any person or entity; or
6) disparages or injures the reputation or goodwill of the Sponsor or any of its respective officers, directors, employees, products, or services.
e. Sponsor reserves the right in its sole discretion to reject or disqualify any Entry for failure to fully comply with these Official Rules. Participants may be required to submit proof of compliance with these requirements, and failure to provide such proof on request may, in the Sponsor’s sole discretion, disqualify a participant’s Entry.
f. Neither submission of an Entry nor any other participation in the Contest creates any confidential, fiduciary, agency, employment, or similar relationship or contract between Sponsor and any participant, and by submitting an Entry each participant acknowledges that no such relationship or contract exists.
g. By entering the Contest, each participant represents and warrants to the Sponsor that:
i. The participant’s Entry meets all of the requirements in this Section 6;
ii. The participant meets all the eligibility requirements for the Contest; and
iii. The participant has complied with these Official Rules and all applicable Laws in entering and participating in the Contest.
7. JUDGING PROCESS AND WINNER DETERMINATION:
a. Winners: One hundred (100) Entries will be selected as the winning Entries and each participant who submitted a winning Entry will be a “Winner.”
b. Judging Period: The Winners will be selected between the end of the Contest Period and approximately August 6th, 2025 (the “Judging Period”).
c. Judges: Eligible Entries will be judged by Sponsor’s marketing team (collectively, the “Judges”).
d. Judging Process: The Judges will assess the Entries based on the following criteria (“Criteria”):
e. Relevance of the Entry to the prompt (25%); and
f. How well the Entry reflects personal stories, heartfelt reflections, or unique perspectives on what feeding time means for the participant and the participant’s baby (75%).
The Judges will award point values from 1-10 (with 10 being the highest score) for each of the Criteria and each of the Criteria will be weighted as set forth above. The one hundred (100) Entries with the highest total scores will be selected as the winning Entries. In the event of a tie between eligible Entries, the Sponsor has the sole discretion to determine which eligible Entry will be the winning Entry based on the overall quality and timeliness of each Entry.
g. Chances of Winning: The chances of winning a prize depend on the number of eligible Entries received during the Contest Period and the quality of each Entry as evaluated on the basis of the Criteria and process described in these Official Rules. The Sponsor cannot predict or guarantee any specific number of eligible Entries for the Contest. A PURCHASE OR PAYMENT WILL NOT IMPROVE OR CHANGE THE CHANCES OF WINNING.
8. PRIZE: Each Winner will be awarded the following prize package (“Prize Package”):
- 24 (12.3 oz) cans of Good Start® | Dr. Brown’s™ Gentle Pro™ Formula Powder (estimated retail value: $479.52);
- (1x) Dr. Brown's™ Natural Flow Anti-Colic Options+ First Year Baby Bottle Gift Set (estimated retail value: $25.98); and
- (1x) Dr. Brown’s™ Formula Mixing Pitcher (estimated retail value: $10.99).
Total approximate retail value of each Prize Package is $516.49. The total approximate retail value of all prizes is fifty-one thousand six hundred forty-nine (USD $51,649).
9. GENERAL PRIZE CONDITIONS: All details and other restrictions of the prize(s) not specified in these Official Rules will be determined by the Sponsor in its sole discretion. No prize is exchangeable, assignable, or otherwise transferable, and may not be redeemed for cash, except at the Sponsor’s sole and absolute discretion. The Sponsor reserves the right to substitute for any prize one or more items or services of equal or greater value in its sole discretion. The value of the prize may be taxable to each Winner as income. The reporting and payment of all tax liabilities incurred by any Winner as a result of the Contest, including but not limited to federal, state, and local income taxes, is the sole responsibility of such Winner. All federal, state, and local laws and regulations apply.
10. WINNER NOTIFICATION AND PRIZE CLAIM: Within ten (10) working days of the conclusion of the Judging Period, each potential Winner will receive a notification email from the Sponsor (a “Prize Notification”) sent to the email address indicated by such potential Winner in his/her applicable winning Entry. Each potential Winner will have ten (10) business days to respond in writing (including by email) to the Prize Notification once it has been sent to such potential Winner, including providing any requisite information to accept their prizes. The Sponsor shall have no liability for any Prize Notification that is lost, intercepted, or not received by a potential Winner for any reason. Each Winner may be required to provide his/her permanent address or Social Security Number for tax reporting purposes to claim a prize. Each Winner may also be required to complete applicable tax documents and return them to Sponsor in order to claim a prize. Each potential Winner may also be required to sign an affidavit of eligibility, a liability release, a publishing rights release, and/or a publicity release (where permitted by law) (the “Eligibility Documents”). If potential Winner does not respond within 10 business days from the Prize Notification, is found to be ineligible, is has not complied with these Official Rules, or fails to complete and return the Eligibility Documents within the time prescribed herein, or if the Prize notification is returned as undeliverable, or if the potential Winner rejects the Prize, the applicable Prize Package will be forfeited and, at Sponsor’s sole discretion, an alternate Winner may be selected from the pool of remaining participants based on the Judging Criteria described in these Official Rules. The Sponsor may successively attempt to contact up to five (5) potential Winners in accordance with such procedure, and if there is still no confirmed Winner of a prize after such attempts have been made, the Sponsor may announce an alternate means for awarding that prize, which may include donating the prize to a charity of the Sponsor’s choosing. The distribution of the prize(s) will be at the sole determination of the Sponsor to the participants deemed to have won the Contest by the Sponsor in accordance with these Official Rules. Upon prize forfeiture, no compensation will be given. The prize will be shipped to each Winner at the provided mailing address. The potential Winners will be subject to all requirements set forth in these Official Rules. The potential Winners are subject to verification, including verification of age and residency by Sponsor whose decision is final and binding in all matters related to the Contest.
11. LICENSE: By entering the Contest, each participant irrevocably grants Sponsor and its designees the unconditional, irrevocable, and perpetual right and permission, royalty-free, to use the Entry and any other work of authorship, data, ideas, information, images, content, or materials included in such Entry, for any and all advertising and promotional purposes in any and all media now known or hereafter invented (including but not limited to digital and print media) without territorial or time limitations and without further consideration, at the sole discretion of the Sponsor, unless prohibited by law, in conjunction with this Contest and similar promotions without notice to such participant. Further, submission of an Entry grants the Sponsor and its representatives the exclusive right to use, edit, illustrate, abridge, modify, and publish the Entry, including any comments or photographs, in any way for any and all purposes in any and all media whether now known or hereafter invented (including but not limited to print and digital media) without territorial or time limitations and without further consideration, at the sole discretion of the Sponsor. The participant will have no right of approval, no claim to any compensation, or no claim arising out of the use, alteration, distortion, or illusionary effect or use in any composite form of the participant’s Entry. Each participant waives all intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor's use of the Entry or exercise of any rights granted to Sponsor as stated in this paragraph, and each participant agrees not to sue or assert any claim against the Contest Entities with respect to any such use.
12. RELEASE OF LIABILITY: By entering the Contest, each participant (a) agrees that none of the Contest Entities shall be responsible for, and (b) to the maximum extent permitted by Law, releases and holds harmless the Contest Entities from and against, any and all claims, injuries, damages, liabilities, costs, expenses, or losses of any kind (including, but not limited to, personal injury, death, or damage to or loss of property) that may occur, directly or indirectly, in whole or in part, from:
a. participation in the Contest;
b. any breach or other violation by such participant of these Official Rules or applicable Law;
c. the acceptance, receipt, possession and/or use or misuse of any prize (or any portion of any prize);
d. any incorrect, incomplete, garbled, or inaccurate information, or any failure to capture any information, whether caused by an participant, printing errors, human error, or by any of the equipment or programming associated with or utilized in the Contest;
e. any damage to an participant’s equipment (such as a computer system or mobile device) which is occasioned by participating in the Contest;
f. miscommunications, or any failed, jumbled, delayed, or misdirected computer, telephone, cable, or other transmissions (including, without limitation, transmissions by email, social media (such as a private or direct messages, check-ins, tweets, and posts), and instant message);
g. for any technical malfunctions, failures, delays, difficulties, or other errors of any kind or nature;
h. any Entry, email, or other material or correspondence that has been tampered with or that is stolen, misdirected, incomplete, lost, late, non-conforming, ineligible, or damaged;
i. any use of a participant’s personal information and Entries as permitted under these Official Rules; or
j. any other events beyond a Sponsor’s reasonable control.
The foregoing release does not include claims, injuries, damages, liabilities, costs, expenses, or losses related to personal injury, death, or damage to or loss of property of an participant to the extent that such claims or losses occur, directly or indirectly, in whole or in part, from the negligence of one or more of the Contest Entities.
13. LIMITATION OF LIABILITY: NEITHER SPONSOR NOR ANY OTHER CONTEST ENTITY, SHALL BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE CONTEST, ANY PRIZE, OR THESE OFFICIAL RULES, HOWSOEVER CAUSED, WHETHER ARISING IN TORT, CONTRACT, STRICT LIABILITY, OR OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER SUCH CONTEST ENTITY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ALL SUCH DAMAGES ARE HEREBY DISCLAIMED AND EXCLUDED. ALL PRIZES ARE GIVEN AWAY “AS IS.” THE CONTEST ENTITIES DO NOT MAKE AND HEREBY DISCLAIM ANY WARRANTIES, CONDITIONS, REPRESENTATIONS OR GUARANTEES, WHETHER EXPRESS, IMPLIED, OR STATUTORY (INCLUDING WITHOUT LIMITATION ANY IMPLIED OR STATUTORY WARRANTY OF MERCHANTABILITY (OR SATISFACTORY QUALITY), FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT) WITH REGARD TO THE CONTEST OR ANY PRIZE.
14. DISQUALIFICATION: The Sponsor reserves the right in its sole discretion to disqualify any participant who the Sponsor finds, in their its discretion, to be tampering with the participation process or the operation of the Contest or the Contest Site, to be acting in violation of these Official Rules, to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by Law.
15. TERMINATION/MODIFICATION: The Sponsor shall have the right to modify, suspend, or terminate the Contest, at its sole discretion, at any time for any reason and without prior individual notice, including without limitation as a result of natural disaster, equipment failure, civil disturbance, fraud, financial, or administrative difficulties, technical problems (such as a computer virus/bug), unauthorized intervention that corrupts the administration, security, fairness, integrity or proper functioning of the Contest, or other causes not within the control of the Sponsor. In addition, if, in the exclusive judgment of the Sponsor, the Contest (or any portion thereof) becomes compromised in any way, or the Contest does not run as contemplated by the Sponsor, the Sponsor reserves the right, at its sole discretion, to cancel any method of entry, to void any Entries submitted fraudulently, to modify or cancel the Contest, and/or to select the Winner from among all non-suspect eligible Entries received prior to the act that compromised the Contest. Should the Contest ever be terminated prior to the Winner selection, the Sponsor will make alternate arrangements to award the prize. The Sponsor reserves the right to make changes in these Official Rules in their sole discretion. If such cancellation, termination, modification, or suspension occurs, notification will be posted on the Contest Site. Any such changes will become effective upon notice.
16. INTERPRETATION: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
17. OFFICIAL RULES AND WINNERS: To request a copy of these Official Rules or to obtain written notice of the Winners of the Contest, send a self-addressed stamped envelope to Attn: Perrigo x Dr Browns Gentle Formula Contest 2025, PBM Nutritionals, LLC, 515 Eastern Avenue, Allegan, Michigan 49101 or to send an email to support@goodstartbaby.com. All such requests must refer to the Contest and be received no later than six (6) months after the end of the Contest Period. These Official Rules will be posted on the Contest Site during the Contest Period and for two (2) weeks after that.
18. COLLECTION OF INFORMATION: Participants agree that all personal data collected by or on behalf of Sponsor (for example, name and state/territory of residence) may be disclosed to the Contest Entities and used by Sponsor or any of the Contest Entities for the administration of the Contest (for example, it may be used by Sponsor in order to verify the participant’s identity, email address, postal address, and telephone number or to otherwise verify the participant’s eligibility to participate in the Contest). In addition, except to the extent prohibited by Law, each Winner grants to the Sponsor and each of its respective designees the right to publicize such Winner's name and address (city and state/territory of residence), photo, and prize information in connection with the Contest, in any media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission. If an participant objects to the publication or making available of their name, address (city and state/province of residence), photo, and prize information, the participant must contact Sponsor at support@goodstartbaby.com. In such circumstances, the Sponsor may still provide the information and winning Entry to third parties (e.g., regulators) where required by applicable Law, such as for tax reporting purposes or to show that a valid award took place.
19. GOVERNING LAW AND JURISDICTION: Except where prohibited, all participants agree that by entering the Contest:
a. All disputes, issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the participant and the Sponsor in connection with these Official Rules or the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
b. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, if any, but in no event will attorneys’ fees be included; and
c. Under no circumstances will participant be permitted to obtain awards for, and each participant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
d. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
20. NO ENDORSEMENT: Nothing contained in these Official Rules or in any of the Contest materials should be construed as an endorsement by any Sponsor of any third party, product, or service.
